The following is my perception of how the legal situation stands with online gambling in the U.S.

As you might know, different states in the U.S often seem to have slightly different rules to others, but when it comes to gambling and the recent exclusion of players from most poker sites, this law, is encompassed by what is called a federal law. This means it is a law across the country and does not change in certain states.
This law decrees, that no gaming company is allowed to accept payment from U.S players in the form of depositing transactions. The act of playing poker, and even playing poker for money online as I understand it, is not illegal. But if you think about it, barring players from making cash depositis onto a gambling site effectively does prevent them from playing altogether. Games which are designated as games of skill are exempt from this ruling. With this in mind, the argument was ignited as to whether poker is predominantly a game of luck or skill. Basically, to make poker exempt from the ruling, lawyers would have to prove that the game of poker was over 50% skill based, and this is no easy task. The folks in the U.S who made these laws banning American players from depositing money, of course probably know very little about poker. And just like everyone else who knows very little of poker, they assume it is mostly a game of luck.
Poker players such as myself know that the game is certainly a mixture of the two, and you could easily argue that the game is slightly more skill, than luck based. The problem is, it is not fellow poker players who are trying to be convinced of this, and that makes the situation very difficult indeed. In short, online poker in the U.S appears to be legal, but depositing any money on such sites, is not.
